HOUSE BILLS:

HB-11 – Maryland Correctional Enterprises Goods & Services-Sales to Individuals Employed by the State Government.  Authorizing the sale of goods and services of Maryland Correctional Enterprises on the open market to an individual employed by the State government.  (Delegate Folden) First Reading Health & Government Operations 1/10.

 HB-15 – Harford County Sheriff-Deputy Sheriffs and Correctional Officers-Organization and Negotitian. Providing that full-time deputy sheriffs at the rank of captain and below and full-time correctional officers at the rank of captain and below in the Office of the Sheriff of Harford County have the right to organize and negotiate with the Harford County Executive and Harford County Sheriff with regard to certain wages and employee health care premium share; requiring the right to organize and negotiate to be conducted in accordance with certain provisions of Harford County Code unless otherwise provided in the Act; etc.   (Delegates Lisanti, Cassilly, and Reilly)   First Reading Appropriations 1/10.

HB-36 – Correctional Officers’ Retirement System-Membership.  Altering the membership of the Correctional Officers’ Retirement System to include certain individuals serving in certain positions in the Department of Juvenile Services; providing that certain members of the Correctional Officers’ Retirement System who meet certain criteria may receive a normal Service retirement allowance that is based on certain creditable service; etc.   (Delegate Jackson)  First Reading Appropriations 1/10.

HB-65 – Criminal Procedure-Domestic Violence-Active Electronic Monitoring-Pretrial Release and Probation.  Requiring a certain judicial officer to consider including, if requested by a victim, electronic monitoring that provides a certain victim notification as a condition of pretrial release; authorizing a judge to order that a defendant be subject to electronic monitoring that provides a certain victim notification as a condition of pretrial release; specifying that the court may include electronic monitoring that provides a certain victim notification as a condition of probation; etc.   (Delegate Angel)   Hearing 1/18 @ 1:00 P.M.

HB-83 – Harford County Sheriff-Deputy Sheriffs and Correctional Officers-Collective Bargaining.  (Wording similar to that in HB-15)  (Delegate Reilly)   First Reading Appropriations 1/12.

HB-110 – St. Mary’s County-Inmate Release Programs.   Authorizing the St. Mary’s County Sheriff to establish a pretrial release program and a prerelease program; authorizing a certain inmate to leave a certain detention center for certain purposes; repealing a provision authorizing the Sheriff and the Board of County Commissioners of St. Mary’s County to charge a certain inmate a certain amount or fee to pay for certain costs; requiring the Sheriff or the Sheriff’s  designee to collect the earnings of a certain inmate, less any payroll deduction required by law; etc.   (St. Mary’s County Delegation)  Hearing 1/23 @ 1:00 P.M.

HB-111 – Maryland Department of Health-Defendants Found Incompetent to Stand Trial or Not Criminally Responsible-Commitment.  Requiring a court to enter a certain commitment order if the court makes a certain finding; requiring the Maryland Department of Health to facilitate the immediate placement of certain defendants in a certain facility on or before a certain date specified in a commitment order and to provide certain notification to the court; establishing a rebuttable presumption of contempt under certain circumstances; providing that a lack of available beds in a certain facility is not sufficient reason for not making a certain placement; etc.  (Delegates Barron, Lierman, Dumais and Angel)   Hearing 1/23 @ 1:00 P.M.

HB-129 – Income Tax-Subtraction Modification-Retirement Income of Correctional Officers.   Expanding a certain subtraction modification under the Maryland income tax to the first $15,000 of retirement income attributable to a resident’s employment as a correctional officer under certain circumstances; and applying the Act to taxable years beginning after December 31, 2017.  (Delegates Knotts and Jackson)   First Reading Ways and Means 1/15.

HB-202 – Criminal Procedure-Incompetency and Criminal Responsibility-Court Ordered Medication. Authorizing a court to order administration of psychiatric medication to a defendant for a period of no longer than 30 days after a finding of incompetency or not criminally responsible under certain circumstances; providing that certain medication may be administered to a certain individual before the decision of a certain panel for no longer than 30 days under certain circumstances; requiring a certain panel to issue a certain decision within 30 days after a court orders treatment under certain circumstances; etc. (Delegates Morhaim, Atterbeary, Dumais Krebs, Rose, Shoemaker, & P. HB-205 – Workers’ Compensation-Permanent Partial Disability-State Correctional Officers.  Providing for enhanced workers’ compensation benefits for a State correctional officer for a compensable permanent partial disability of less than 75 weeks; and applying the Act prospectively.   (Delegates Clippinger & Buckel)   First Reading Economic Matters 1/18.

HB-291 – Correctional Services-Inmate Case Record-Inmate Case Record-Educational, Vocational, and Job History.  Requiring the Division of Correction to conduct certain educational, vocational, and job history interview for each inmate as soon as feasible after the individual is sentenced to the jurisdiction of the Division; and requiring the Division to include the results of a certain educational, vocational, and job history interview in certain inmate case records.

 HB-295 – Correctional Services-Diminution Credits-Education.  Awarding a one-time diminution credit to reduce the term of confinement of an inmate if the inmate successfully obtains a certain educational certificate, diploma, or degree; establishing a diminution credit of not less than 60 days and not more than 730 days that may be awarded; and requiring the Commissioner of Correction to establish a uniform system of deductions and participation criteria for awarding Certain diminution credit.

HB-296 – Income Tax-Subtraction Modification-Retirement Income of Correctional Officers.  Expanding a certain subtraction modification under the Maryland income tax to include certain retirement income attributable to a resident’s employment as a correctional officer under certain circumstances; and applying the Act to taxable years beginning after December 31, 2017.

HB-373 – Cecil County-Home Detention and Release Programs.   Repealing provisions relating to a home detention program in Cecil County; authorizing the Sheriff of Cecil County to establish home detention, pretrial release, work release, and prerelease programs; requiring the Sheriff to adopt regulations necessary to implement the programs; providing that a certain condition imposed by a court supersedes a certain regulation under certain circumstances; authorizing a court to allow a certain individual to participate in a program established under the Act at a certain time; etc.  (Cecil County Delegation)   First Reading Judiciary 1/24.

HB-447 –  Pretrial Services Program Grant Fund-Establishment. Requiring that certain proceeds from the sale of certain forfeited property be paid to the Pretrial Services Program Grant Fund; establishing the Pretrial Services Grant Fund to provide grants to eligible counties to establish pretrial services programs; requiring the Executive Director of the Governors’ Office of Crime Control and Prevention to administer the Fund; providing for the uses, purposes, sources of funding, investment of money, and auditing of the Fund; etc.  (Delegates Barron, Dumais, Anderson, Hettleman, Korman, Lierman, Moon, and Sydnor.)  First Reading Judiciary and Appropriations 1/25.

HB-628 – Correctional Services-Inmates-Labor.  Requiring the Commissioner of Correction to include in an annual report certain statistics related to inmate employment and wages at certain facilities; and requiring the Division of Correction to include in a report regarding Maryland Correctional Enterprises certain statistics regarding inmate employment and wages.   (Delegate Wilkins, et al.)  First Reading Judiciary 1/29.

HB-678 –  Criminal Law-Sentencing-Subsequent Offenders (career Criminal Truth in Sentencing Act.   Requiring that certain subsequent criminal offenders be sentenced to imprisonment for the maximum term allowed by law; prohibiting the court from suspending all or part of a mandatory sentence for certain subsequent criminal offenders; providing that certain subsequent criminal offenders are not eligible for parole or diminution credits; and requiring that the State follow certain procedural rules when prosecuting certain subsequent criminal offenders.   Introduced in the 2016 Regular Session as HB-1173.   (Delegates Buckel, Cluster, Corderman, Glass, Hornberger, Kittleman, Malone, McComas, Parrott, and Rey.)   Hearing 2/20 1:00 P.M Judiciary.

HB-685 – Criminal Procedure-Pretrial Release-Grace Period for Failure to Appear.   Prohibiting a defendant who fails to appear for a scheduled court hearing from being penalized if he or she turns himself or herself in to the court within 7 days of the missed hearing and if he or she was not arrested or charged with another crime after failure to appear; authorizing a court to order a certain defendant to pay certain fees and costs; and applying the Act.   (Delegate Conway)   Judiciary Hearing 2/20 @ 1:00 P.M.

HB-1255 –  Correctional Services-Retired Officer Identification Card.  Requiring the Division of Correction to provide a certain retiring or retired State correctional officer with a certain identification card under certain circumstances; authorizing the Division of Correction to charge a reasonable fee not to exceed $20 for a certain identification card or a replacement card;  requiring that a certain person meet certain requirements to qualify for a certain identification card; and establishing the form and contents of a certain identification card. HB-1256 –  Public Safety-Deaths Involving a Correctional Officer-Reports.  Requiring State and local Correctional facilities, beginning 2019, to provide the Governor’s Office of Crime Control and Prevention by March 1 each year with certain information on correctional officer-involved deaths of inmates and deaths in the line of duty; requiring, on or before October 15, 2018,  the Office to report to the General Assembly on the number of correctional officer-involved  deaths of inmates and deaths in the line of duty that occurred during the previous 3 calendar  years; etc.  (Delegate Washington)  Introduced in the 2017 Session as HB-1342.  First Reading Judiciary 2/9.

HB-1260 –  District Court-Non-incarcerable Criminal Cases-Saturdays.  Requiring the District Court to conduct business on those Saturdays that do not fall on a State or federal holiday for cases under the court’s exclusive, original, criminal jurisdiction that do not carry a penalty of  confinement; and authorizing the Chief Judge of the District Court to adopt rules to carry out the provisions of the Act.  (Delegate Metzgar, Afzali, Bromwell, Buckel, Hornberger, S. HB-1289 –  Correctional Services-Arrested Persons-Mental Disorder Screenings.  Requiring the Department of Public Safety and Correctional Services and the Maryland Department of Health jointly to establish a uniform mental disorder screening procedure for screening arrested persons; establishing certain requirements for a mental disorder screening test; requiring that each arrested person detained or confined in a correctional facility be screened for a mental disorder as soon as possible, except under certain circumstances; etc.  (Delegates Lam, Barkley, Gutierrez, McComas, Morhaim, and Turner.)  First Reading Judiciary 2/9.

HB-1313 –  Local Correctional Facilities-Prerelease and Work Release Programs-Assessment of Fees. HB-1359 –  Criminal Procedure-Mental Health and Substance Abuse Offender Reentry Support Program. Establishing the Mental Health and Substance Abuse Offender Reentry Support Program in  the Maryland Department of Health; specifying the purpose of the Program; requiring the Department to select at least one local behavioral health authority for each correctional facility to develop certain case plans and provide certain services for certain criminal  offenders; requiring the Department, in consultation with the Department of Public Safety  and Correctional Services and each local correctional facility, to adopt certain regulations;  etc.   (Delegates Ali, Hayes, McCray, M. HB-1397 –  Criminal Procedure-Pretrial Release-Defendant on Parole.  Prohibiting a judicial officer from authorizing pretrial release for a defendant charged with a crime of violence who is on parole until after the conclusion of a certain proceeding for revocation of parole.  (Delegates Hornberger, Corderman, Grammer, and Malone.)  First Reading Judiciary 2/9.

HB-1520 –  Criminal Procedure-Pretrial Release Services Program-Victim.  Requiring a judicial officer to consider the recommendation of a certain pretrial release services program in making a certain determination; requiring a court or District Court commissioner to consider including certain no contact provisions as a condition of pretrial release if a certain pretrial release  services program has made a certain request; requiring a certain pretrial release services program to notify the court on receipt of certain information; etc.  (Delegates Vallario, Conaway, J. HB-1523 –  Criminal Procedure-Domestic Violence Offender Registry.  Requiring the Department of Public Safety and Correctional Services to establish and maintain the Domestic Violence Offender Registry; requiring the Registry to be updated in a certain manner and to include certain information; specifying the contents of the Registry; requiring a certain person convicted three or more times of a domestically related crime to register with a certain county sheriff; exempting a person from registration under certain circumstances; etc.   (Delegates Jackson, Chang, and McConkey.)  Hearing Judiciary 3/01 @ 1:00 P.M.

HB-1635 –  Mental Health Law-Involuntary Admissions-Requirements and Procedures.  Requiring the Maryland Department of Health to provide for admission of a certain emergency evaluee to a certain State facility or other certain facility within 6 hours after notification; and prohibiting a certain hearing officer from ordering the release of an individual who meets the requirements for involuntary admission under a certain provision of law on certain grounds.  Cross-filed with SB-947.  (Delegates Morhaim and Pena-Melnyk.)  First Reading 2/9.

HB-1723 – Charles County-Work Release-Collection of Inmate Earnings.  Requiring an inmate participating in a work-release arrangement in Charles County to pay court-ordered restitution, public defender fees, child support, and food, lodging, electronic monitoring, and clothing costs; requiring the Charles County Sheriff to establish certain per diem rates and designate an agent to collect the costs; and requiring the Sheriff’s designee to deliver certain amounts collected to the county treasurer.  (Charles County Delegation)  First Reading House Rules and Executive Nominations 2/19.

HB-1733 – Local Correction Facilities-Requirement for Prerelease Programs.  Requiring the governing body of each county that receives State funding for public safety purposes to establish a certain prerelease program for individuals confined in certain local correctional facilities; requiring a prerelease program to provide that a certain inmate may participate in certain rehabilitative activities under certain circumstances; authorizing a certain judge to approve the transfer of a certain inmate to a prerelease center to participate in a prerelease program under certain circumstances; etc.  (Delegate Haynes)  First Reading House Rules and Executive Nominations 2/19.

HB-1814 –   Task Force and Pilot Program to Study the Integration of Unmanned Aircraft Systems Within State and Local Government Public Safety Operations.  Establishing the Task Force to Study the Integration of Unmanned Aircraft Systems Within State and Local Government Public Safety Operations; providing for the composition, chair, and staffing of the Task Force; requiring the Task Force to study, establish a certain pilot program, and make recommendations regarding certain matters; requiring, for Fiscal Years 2020 and 2021, the Governor to include an appropriation of at least $350,000 in each year in the annual budget Bill in support of the pilot program; etc.  (Delegate Jalisi)  The is an additional notation which says Bill imposes a mandated appropriation in the annual State Budget Bill.  First Reading House Rules and Executive Nominations 3/7.

SB-11 – Income Tax-Subtraction Modification-Retirement Income.   Including income from certain Retirement plans within certain subtraction modification allowed under the Maryland income tax for certain individuals; altering the calculation of the subtraction modification; increasing the maximum amount of the subtraction modification allowed for certain taxable years; and prohibiting an individual from qualifying for the subtraction if the total income from all qualified plans for the taxable year exceeds $100,000.   (Senator Young)  First Reading Budget & Taxation 1/10.

SB-211 – Behavioral Health Programs-Medical Directors-Telehealth.   Requiring that regulations adopted under certain provisions of law regulating behavioral health programs include provisions authorizing a medical director of a behavioral health program located in a federally designated health professional shortage area to provide services through telehealth and prohibiting a behavioral health program located in a federally designated health professional shortage area from requiring a medical director to provide services onsite.   (Senator Waugh)   First Reading   Finance 1/18.

SB-237 – Adult Correctional Institutions-Financial Literacy and Entrepreneurship Curriculum- Development and Implementation.  Requiring the Correctional Education Council, in collaboration with the Division of Workforce Development and Adult Learning in the Department of Labor, Licensing, and Regulation, to develop and implement, on or before July 1, 2019, a financial literacy and entrepreneurship curriculum to be offered as part of certain  transition training to certain inmates in the Division of Correction; and requiring the curriculum content to include certain instruction.   (Senator Robinson)  First Reading Finance 1/19.

SB-249 – Inmates-Life Imprisonment-Parole Reform.   Repealing certain provisions that provide that inmates serving a term of life imprisonment may be paroled only with the Governor’s approval, subject to certain provisions; requiring certain parole decisions to be transmitted to the Governor under certain circumstances; authorizing the Governor to disapprove certain parole decisions in a certain manner; providing that if the Governor does not disapprove a  certain parole decision in a certain manner within a certain time period; the decision becomes  effective; etc.   Introduced in the 2017 Regular Session as HB-723.   (Senator Kelley et al.) SB-703 –  Behavioral Health Crisis Response Grant Program-Establishment.  Establishing the Behavioral Health Crisis Response Grant Program to provide funds to local jurisdictions to establish and expand community behavioral health cris response systems; requiring the Maryland Department of Health to administer the Program; authorizing certain uses of funds distributed under the Program; requiring the Department, by December 1 each year, beginning in 2020, to report to the Governor and the General Assembly certain data regarding the Program; etc. (Senator Klausmeier)  Hearing Finance 2/28 @ 1:00 P.M.

SB-736 –  Criminal Procedure-Pretrial Release-Assault on a Law Enforcement Officer (Police Protection  Act)  Prohibiting a District Court commissioner from authorizing the pretrial release of a defendant who is charged with assault in the first degree or assault in the second degree against a victim who is a law enforcement officer; providing that a judge may authorize the pretrial release of a certain defendant on suitable bail or certain other conditions or both; requiring a judge to order the continued detention of a defendant who is considered a flight risk or one who poses a danger to another person or community; etc.   Cross-filed with HB-1128.  Hearing Judicial Proceedings 2/28 @ 1:00 P.M.

SB-766 –   Criminal Procedure-Pretrial Release Services Program-Victim Notification.   Requiring a judicial officer to consider the recommendation of a certain pretrial release services program in making a certain determination; requiring a court or  District Court commissioner to  consider including certain no contact provisions as a condition of pretrial release if a certain  pretrial release services program has made a certain request; requiring a certain pretrial  release services program to notify the court on receipt of certain information, etc.
